Rainey Law has a highly successful practice in dealing with defective buildings, weathertightness claims and associated issues.

Our team are leading practitioners nationwide in this specialised area of law. They have acted for plaintiffs and defendants in some of the most complex and prominent building defect cases to come before our courts.

Our team is led by Tim Rainey who is well respected as one of New Zealand’s top lawyers in defective building litigation. Tim is frequently asked to present seminars by the New Zealand Law Society and other professional bodies. Tim and our team are often consulted by other lawyers to provide expert advice to them and their clients on issues arising in building defect scenarios.

We strive to provide clear advice and top quality representation for our clients in these matters. Our team recognise the financial and emotional toll that these issues bring to bear on the parties who are involved. It is our goal, in every case, to obtain a fair and just outcome as quickly and economically as we can for clients to enable them to repair their buildings and move on with their lives.

With our reputation for excellence in this area, we are often able to resolve claims without having to go to trial. This success in resolving claims by direct negotiation or mediation reflects our philosophy that an excellent settlement does not happen by accident but is a product of hard work and focussed preparation well before negotiation begins. Preparation routinely includes consulting with other experts such as building surveyors, engineers and quantity surveyors to best advance the client’s case. We have garnered relationships with other experts whom we can highly recommend to clients for this purpose.

If a client’s case is unable to settle, we will take it to trial. It is at trial that our commitment to excellence and determination to present the best case for our clients comes to the fore. Our record of success speaks for itself.

Rainey Law’s most notable success to date is the Nautilus Apartments case (reported as Body Corporate 326421 & Ors v Auckland Council & Ors [2015] NZHC 862). After acting for the owners of a 150-unit complex in Orewa for six years, we were able to obtain judgment for over $24m for our clients. This represented a 97% success rate and is the largest award in a defective building case in New Zealand.
